Your access to Services may depend on your employer’s plan, your enrollment status, or arrangement with a partner clinic.
3. No Medical Advice / Not a Medical Provider
ThriveOrtho, Inc. and its personnel, technologies (including AI-powered tools), and coaches are not a substitute for direct, individualized medical care or advice from licensed medical professionals. To the extent any health or wellness suggestions are provided, they are for general informational purposes only. Always consult a qualified healthcare provider for diagnosis, treatment, or medical advice.
If you participate in our Services, you acknowledge that actual medical evaluation and treatment will be provided by licensed clinicians via our partner clinics (and not directly by ThriveOrtho, Inc.), and that outcomes may vary.
4. User Responsibilities
Accuracy: You agree to provide accurate, current, and complete information when enrolling or providing health history or other data. You must inform us (or your assigned clinician) of any changes to your health condition, contact information, or other relevant details.
Prohibited Use: You agree not to misuse our Services (e.g., entering misleading or improper data, using the platform for unlawful purposes, interfering with other users’ access).
5. Consent To Share & Process Data
By using the Services, you consent to us collecting, using, storing, and sharing your personal and health data as described in the Privacy Policy — including with partner clinics, providers, wellness coaches, and third-party service providers.
You also consent to the use of technology-based tools (e.g., AI-enabled movement analysis, home-exercise monitoring, telehealth / virtual visits) as part of your care.
6. Limitation of Liability
To the maximum extent permitted by applicable law, ThriveOrtho, Inc. disclaims all liability for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to your use of the Services — including but not limited to injury, delayed treatment, loss of data, or reliance on any AI-generated or digital recommendations.
We do not guarantee specific outcomes, results, or improvements. Results depend on many factors including your compliance, health condition, and participation in care recommendations.
7. Termination / Suspension of Services
We may suspend or terminate, at our discretion, your access to the Services — for example if you violate these Terms, provide false or misleading data, or upon request. Upon termination, we may delete or deactivate your account and discard certain data, subject to retention requirements.
You may also request account deletion or data erasure in accordance with the mechanisms described in the Privacy Policy.
8. Modifications to Term
Given that we may process sensitive health information (MSK history, injury data, therapy notes, functional assessments), such data will be treated with the highest level of confidentiality. Where applicable, we will comply with relevant health-data privacy regulations (e.g., HIPAA for U.S.-based care). In case of any conflict between this Privacy Policy and a separate Notice of Privacy Practices governing protected health information (PHI), the latter will take precedence. This approach is similar to that of other digital-health platforms offering MSK care.
